1. Acceptance of Terms

By accessing or using GuideAndMe (the "Platform"), you confirm that you are at least 18 years old and agree to be bound by these Terms of Use (the "Terms").

If you do not agree to these Terms, you must not use the Platform.

2. Nature of the Service

GuideAndMe is a neutral online platform that connects travelers ("Travelers") with independent local tour guides ("Guides").

• We do not provide, operate, manage, or supervise any tours.
• We are not a travel agency, tour operator, or employer of any Guide.
• All bookings, agreements, and interactions are made directly between users.

The Platform is currently provided free of charge. We do not charge any fees, commissions, or subscriptions at this time.

3. Guide Review Disclaimer

Guides may go through an internal review process before being listed on the Platform. However, this process is for operational purposes only and does not constitute:

• Identity verification
• Background checks
• Certification validation
• Any form of endorsement or guarantee

We make no representations or warranties regarding the identity, qualifications, or suitability of any Guide.

4. User-to-User Transactions

The Platform only facilitates connections between users.

We are not responsible for:

• Booking arrangements
• Pricing agreements
• Payment methods
• Cancellations or refunds
• No-shows

All such matters are solely the responsibility of the users involved.

Any communication or transactions conducted outside the Platform (e.g., email, messaging apps) are also entirely at your own risk.

5. Cancellations, Refunds, and Disputes

GuideAndMe does not provide or enforce cancellation or refund policies.

• All terms must be agreed upon between Travelers and Guides.
• We have no obligation to mediate or resolve disputes between users.

6. Safety and Assumption of Risk

Some tours or activities may involve inherent risks.

By participating, you acknowledge and agree that:

• You participate voluntarily
• You assume all associated risks
• You are responsible for assessing your own physical condition and ability

7. Insurance

GuideAndMe does not provide any insurance coverage.

Users are responsible for obtaining any necessary insurance, including:

• Travel insurance
• Health or accident insurance
• Any other relevant coverage

8. Disclaimer of Warranties & Limitation of Liability

The Platform is provided on an "as-is" and "as-available" basis.

We expressly disclaim all liability for:

• Injury, illness, death, or damages resulting from tours
• The quality, safety, or legality of services provided by Guides
• The accuracy of user-generated content
• Fraud, disputes, or misconduct between users
• Service interruptions or technical failures
• Events beyond our reasonable control

To the maximum extent permitted by law, our total liability shall not exceed zero (0), as the Platform is provided free of charge.

9. User Content

By posting content (e.g., photos, descriptions, reviews), you:

• Confirm that you own or have the necessary rights to the content
• Grant GuideAndMe a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and promote such content

We reserve the right to remove any content at our discretion without prior notice.

10. Acceptable Use

You agree not to:

• Post false, misleading, or fraudulent information
• Harass, threaten, or harm other users
• Use the Platform for illegal purposes
• Attempt unauthorized access to systems or accounts
• Collect personal data without consent

11. Account Responsibility

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

12. Suspension and Termination

We may suspend or terminate your account without prior notice if:

• You violate these Terms
• You engage in harmful or unlawful behavior
• You pose a risk to other users or the Platform

You may request account deletion at any time.

13. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without notice.

14. Indemnification

You agree to indemnify and hold harmless GuideAndMe and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from:

• Your use of the Platform
• Your content
• Your violation of these Terms or applicable laws

15. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Korea.

Any disputes shall be subject to the exclusive jurisdiction of the courts located in Seoul, Korea.

16. Changes to Terms

We may update these Terms at any time.

For material changes, we will provide at least 7 days' notice via email. Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.

17. Privacy

Your personal data is handled in accordance with our separate Privacy Policy.
